A. If a claimant fails to respond to a notice of missing information under BC 1.65.020(B) within 60 days, the claim will be deemed withdrawn.

B. On receipt of a complete claim, City staff will prepare a written recommendation to the City Council.

C. City shall provide notice of a public hearing on the claim at least 30 days prior to the public hearing. The notice shall be sent to:

1. All property owners of record within 250 feet of the subject property, including all owners of the property;

2. Deschutes County;

3. The recognized neighborhood association in which the subject property is located; and

4. The Department of Land Conservation and Development.

D. The notice shall contain:

1. A description of the claim and the property;

2. The date, time and place of the hearing;

3. A statement that judicial review of the City’s decision and final determination on the claim will be limited to the written evidence and arguments submitted to the City;

4. A statement that judicial review is available only for issues raised with sufficient specificity to allow the City to respond.

5. A statement that all testimony and written submittals must be submitted prior to the close of the final public hearing on the claim;

6. Any other information deemed appropriate by the City.

E. A staff report recommending approval or denial and addressing the approval criteria shall be prepared and will be available at least seven calendar days prior to the hearing. If the recommendation is for approval, the staff report shall include a recommendation on the amount of compensation or the extent of the waiver recommended. [Ord. NS-2159, 2011]
