The City shall summarily reject a claim if:

A. The claim is not filed within five years from the date the land use regulation was enacted;

B. An application for a comprehensive plan or zoning amendment has been approved for the subject property since the date of the regulation complained of; or

C. The highest and best use of the property was not residential at the time the land use regulation was enacted. [Ord. NS-2159, 2011]
